2.1
Toda persona declarada culpable de una infracción penal por un tribunal tendrá derecho a que la declaración de culpabilidad o la condena sea examinada por una jurisdicción superior. El ejercicio de ese derecho, incluidos los motivos por los cuales pueda ser ejercitado, se regularán por ley.
2.2
Este derecho podrá ser objeto de excepciones en caso de infracciones de menor gravedad según las defina la ley, o cuando el interesado haya sido juzgado en primera instancia por el más alto tribunal o haya sido declarado culpable y condenado al resolverse un recurso contra su absolución.

Cuando una condena firme resulte posteriormente anulada, o cuando
se haya concedido un indulto, porque un hecho nuevo o conocido
con posterioridad demuestre que se ha producido un error judicial,
la persona que haya sufrido una pena en virtud de esa condena será
indemnizada conforme a la ley o a la práctica vigente en el Estado
respectivo, excepto cuando se pruebe que la no revelación a tiempo
del hecho desconocido le fuere imputable total o parcialmente.
4.1
Nadie podrá ser perseguido o condenado penalmente por los
tribunales del mismo Estado, por una infracción por la que ya hubiera
sido absuelto o condenado en virtud de sentencia firme conforme a la
ley y al procedimiento penal de ese Estado.
4.2
Lo dispuesto en el párrafo anterior no impedirá la reapertura
del proceso, conforme a la ley y al procedimiento penal del Estado
interesado, cuando hechos nuevos o ulteriormente conocidos o un
vicio esencial en el procedimiento anterior pudieran afectar a la
sentencia dictada.

7.1
Toda persona tiene derecho a la libertad y a la seguridad personales.

Nadie puede ser privado de su libertad física, salvo por las causas y en las condiciones fijadas de antemano por las Constituciones Políticas de los Estados Partes o por las leyes dictadas conforme a ellas.

Nadie puede ser sometido a detención o encarcelamiento arbitrarios.
7.4
Toda persona detenida o retenida debe ser informada de las razones de su detención y notificada, sin demora, del cargo o cargos formulados contra ella.
7.5
Toda persona detenida o retenida debe ser llevada, sin demora, ante un juez u otro funcionario autorizado por la ley para ejercer funciones judiciales y tendrá derecho a ser juzgada dentro de un plazo razonable o a ser puesta en libertad, sin perjuicio de que continúe el proceso. Su libertad podrá estar condicionada a garantías que aseguren su comparecencia en el juicio.
7.6
Toda persona privada de libertad tiene derecho a recurrir ante un juez o tribunal competente, a fin de que éste decida, sin demora, sobre la legalidad de su arresto o detención y ordene su libertad si el arresto o la detención fueran ilegales. En los Estados Partes cuyas leyes prevén que toda persona que se viera amenazada de ser privada de su libertad tiene derecho a recurrir a un juez o tribunal competente a fin de que éste decida sobre la legalidad de tal amenaza, dicho recurso no puede ser restringido ni abolido. Los recursos podrán interponerse por sí o por otra persona.
7.7
Nadie será detenido por deudas. Este principio no limita los mandatos de autoridad judicial competente dictados por incumplimientos de deberes alimentarios.
8.1
Toda persona tiene derecho a ser oída, con las debidas garantías y dentro de un plazo razonable, por un juez o tribunal competente, independiente e imparcial, establecido con anterioridad por la ley, en la sustanciación de cualquier acusación penal formulada contra ella, o para la determinación de sus derechos y obligaciones de orden civil, laboral, fiscal o de cualquier otro carácter.
8.2
Toda persona inculpada de delito tiene derecho a que se presuma su inocencia mientras no se establezca legalmente su culpabilidad.  Durante el proceso, toda persona tiene derecho, en plena igualdad, a las siguientes garantías mínimas:
8.2.a
the right of the accused to be assisted without charge by a translator or interpreter, if he does not understand or does not speak the language of the tribunal or court;
8.2.b
prior notification in detail to the accused of the charges against him;
8.2.c
adequate time and means for the preparation of his defense;
8.2.d
the right of the accused to defend himself personally or to be assisted by legal counsel of his own choosing, and to communicate freely and privately with his counsel;

Nadie puede ser condenado por acciones u omisiones que en el momento de cometerse no fueran delictivos según el derecho aplicable. Tampoco se puede imponer pena más grave que la aplicable en el momento de la comisión del delito. Si con posterioridad a la comisión del delito la ley dispone la imposición de una pena más leve, el delincuente se beneficiará de ello.

Every individual shall have the right to have his cause heard. This comprises:

3.1

Every child accused or found guilty of having infringed penal law shall have the right to special treatment in a manner consistent with the child’s sense of dignity and worth and which reinforces the child’s respect for human rights and fundamental freedoms of others.

State Parties to the present Charter shall in particular:

ensure that no child who is detained or imprisoned or otherwise deprived of his/her liberty is subjected to torture, inhuman or degrading treatment or punishment;

ensure that children are separated from adults in their place of detention or imprisonment;

ensure that every child accused of infringing the penal law:

shall be presumed innocent until duly recognized guilty;

shall be informed promptly in a language that he understands and in detail of the charge against him, and shall be entitled to the assistance of an interpreter if he or she cannot understand the language used;

shall have the matter determined as speedily as possible by an impartial tribunal and if found guilty, be entitled to an appeal by a higher tribunal;

prohibit the press and the public from the trial.
17.3
The essential aim of treatment of every child during the trial and also if found guilty of infringing the penal law shall be his or her reformation, reintegration into his or her family and social rehabilitation.

Women and men are equal before the law and shall have the right to equal protection and benefit of the law. States Parties shall take all appropriate measures to ensure:
8.a
effective access by women to judicial and legal services, including legal aid;
8.b
support to local, national, regional and continental initiatives directed at providing women access to legal services, including legal aid;
8.c
the establishment of adequate educational and other appropriate structures with particular attention to women and to sensitise everyone to the rights of women;
8.d
that law enforcement organs at all levels are equipped to effectively interpret and enforce gender equality rights;
8.e
that women are represented equally in the judiciary and law enforcement organs;
8.f
reform of existing discriminatory laws and practices in order to promote and protect the rights of women.

States Parties shall undertake to:
25.a
provide for appropriate remedies to any woman whose rights or freedoms, as herein recognised, have been violated;
25.b
ensure that such remedies are determined by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by law.

include in their national constitutions and other legislative instruments, if not already done, the principle of equality between women and men and ensure its effective application;

integrate a gender perspective in their policy decisions, legislation, development plans, programmes and activities and in all other spheres of life;

Women shall have the right to fully enjoy their right to sustainable development. In this connection, the States Parties shall take all appropriate measures to:

4.1
The Parties undertake to guarantee to persons belonging to national minorities the right of equality before the law and of equal protection of the law. In this respect, any discrimination based on belonging to a national minority shall be prohibited.
9.1
The Parties undertake to recognise that the right to freedom of expression of every person belonging to a national minority includes freedom to hold opinions and to receive and impart information and ideas in the minority language, without interference by public authorities and regardless of frontiers. The Parties shall ensure, within the framework of their legal systems, that persons belonging to a national minority are not discriminated against in their access to the media.
9.2
Paragraph 1 shall not prevent Parties from requiring the licensing, without discrimination and based on objective criteria, of sound radio and television broadcasting, or cinema enterprises.
9.3
The Parties shall not hinder the creation and the use of printed media by persons belonging to national minorities. In the legal framework of sound radio and television broadcasting, they shall ensure, as far as possible, and taking into account the provisions of paragraph 1, that persons belonging to national minorities are granted the possibility of creating and using their own media.
9.4
In the framework of their legal systems, the Parties shall adopt adequate measures in order to facilitate access to the media for persons belonging to national minorities and in order to promote tolerance and permit cultural pluralism.

the inducement, coercion or encouragement of a child to engage in any sexual activity;

All peoples shall have the right to national and international peace and security. The principles of solidarity and friendly relations implicitly affirmed by the Charter of the United Nations and reaffirmed by that of the Organization of African Unity shall govern relations between States.
