 العهد الدولي الخاص بالحقوق المدنية والسياسية 7 لا يجوز إخضاع أحد للتعذيب ولا للمعاملة أو العقوبة القاسية أو اللاإنسانية أو الحاطة بالكرامة. وعلى وجه الخصوص، لا يجوز إجراء أية تجربة طبية أو علمية على أحد دون رضاه الحر.
17.1 لا يحوز تعريض أي شخص، على نحو تعسفي أو غير قانوني، لتدخل في خصوصياته أو شؤون أسرته أو بيته أو مراسلاته، ولا لأي حملات غير قانونية تمس شرفه أو سمعته.
17.2 من حق كل شخص أن يحميه القانون من مثل هذا التدخل أو المساس.
العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية 3 تتعهد الدول الأطراف في هذا العهد بضمان مساواة الذكور والإناث في حق التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية المنصوص عليها في هذا العهد.
12.1 تقر الدول الأطراف في هذا العهد بحق كل إنسان في التمتع بأعلى مستوى من الصحة الجسمية والعقلية يمكن بلوغه.
12.2 تشمل التدابير التي يتعين على الدول الأطراف في هذا العهد اتخاذها لتأمين الممارسة الكاملة لهذا الحق، تلك التدابير اللازمة من أجل:
12-2-(أ) العمل علي خفض معدل موتي المواليد ومعدل وفيات الرضع وتأمين نمو الطفل نموا صحيا،
اتفاقية حقوق الطفل 24.1 تعترف الدول الأطراف بحق الطفل في التمتع بأعلى مستوى صحي يمكن بلوغه وبحقه في مرافق علاج الأمراض وإعادة التأهيل الصحي. وتبذل الدول الأطراف قصارى جهدها لتضمن ألا يحرم أي طفل من حقه في الحصول على خدمات الرعاية الصحية هذه.
24.2 تتابع الدول الأطراف إعمال هذا الحق كاملا وتتخذ، بوجه خاص، التدابير المناسبة من أجل:
24-2-(و) تطوير الرعاية الصحية الوقائية والإرشاد المقدم للوالدين، والتعليم والخدمات المتعلقة بتنظيم الأسرة.
34 تتعهد الدول الأطراف بحماية الطفل من جميع أشكال الاستغلال الجنسي والانتهاك الجنسي. ولهذه الأغراض تتخذ الدول الأطراف، بوجه خاص، جميع التدابير الملائمة الوطنية والثنائية والمتعددة الأطراف لمنع:
34-(أ) حمل أو إكراه الطفل على تعاطى أي نشاط جنسي غير مشروع،
34 تتعهد الدول الأطراف بحماية الطفل من جميع أشكال الاستغلال الجنسي والانتهاك الجنسي. ولهذه الأغراض تتخذ الدول الأطراف، بوجه خاص، جميع التدابير الملائمة الوطنية والثنائية والمتعددة الأطراف لمنع:
34-(ب) الاستخدام الاستغلالي للأطفال في الدعارة أو غيرها من الممارسات الجنسية غير المشروعة،
34 تتعهد الدول الأطراف بحماية الطفل من جميع أشكال الاستغلال الجنسي والانتهاك الجنسي. ولهذه الأغراض تتخذ الدول الأطراف، بوجه خاص، جميع التدابير الملائمة الوطنية والثنائية والمتعددة الأطراف لمنع:
34-(ج) الاستخدام الاستغلالي للأطفال في العروض والمواد الداعرة.

5 تتخذ الدول الأطراف جميع التدابير المناسبة لتحقيق ما يلي:
5-(ب) كفالة تضمين التربية العائلية فهما سليما للأمومة بوصفها وظيفة اجتماعية، الاعتراف بكون تنشئة الأطفال وتربيتهم مسؤولية مشتركة بين الأبوين على أن يكون مفهوما أن مصلحة الأطفال هي الاعتبار الأساسي في جميع الحالات .
12.1 تتخذ الدول الأطراف جميع التدابير المناسبة للقضاء على التمييز ضد المرأة في ميدان الرعاية الصحية من أجل أن تضمن لها، على أساس المساواة بين الرجل والمرأة، الحصول على خدمات الرعاية الصحية، بما في ذلك الخدمات المتعلقة بتنظيم الأسرة.
12.2 بالرغم من أحكام الفقرة 1 من هذه المادة تكفل الدول الأطراف للمرأة خدمات مناسبة فيما يتعلق بالحمل والولادة وفترة ما بعد الولادة، موفرة لها خدمات مجانية عند الاقتضاء، وكذلك تغذية كافية أثناء الحمل والرضاعة.
14.2 تتخذ الدول الأطراف جميع التدابير المناسبة للقضاء على التمييز ضد المرأة في المناطق الريفية لكي تكفل لها، على أساس المساواة بين الرجل والمرأة، أن تشارك في التنمية الريفية وتستفيد منها، وتكفل للريفية بوجه خاص الحق في:
14-2-(ب) To have access to adequate health care facilities, including information, counselling and services in family planning;
16.1 تتخذ الدول الأطراف جميع التدابير المناسبة للقضاء على التمييز ضد المرأة في كافة الأمور المتعلقة بالزواج والعلاقات العائلية، وبوجه خاص تضمن، على أساس المساواة بين الرجل والمرأة:
16-1-(ه) نفس الحقوق في أن تقرر، بحرية وبإدراك للنتائج، عدد أطفالها والفاصل بين الطفل والذي يليه، وفى الحصول على المعلومات والتثقيف والوسائل الكفيلة بتمكينها من ممارسة هذه الحقوق،
اتفاقية حقوق الأشخاص ذوي الإعاقة
23.1 تتخذ الدول الأطراف تدابير فعالة ومناسبة للقضاء على التمييز ضد الأشخاص ذوي الإعاقة في جميع المسائل ذات الصلة بالزواج والأسرة والوالدية والعلاقات، وعلى قدم المساواة مع الآخرين، وذلك من أجل كفالة ما يلي:
23-1-(ب) الاعتراف بحقوق الأشخاص ذوي الإعاقة في اتخاذ قرار حر ومسؤول بشأن عدد الأطفال الذين يودون إنجابهم وفترة التباعد بينهم وفي الحصول على المعلومات والتثقيف في مجالي الصحة الإنجابية وتنظيم الأسرة بما يتناسب مع سنهم، وتوفير الوسائل الضرورية لتمكينهم من ممارسة هذه الحقوق،
25 تعترف الدول الأطراف بـأن للأشخاص ذوي الإعاقة الحق في التمتع بأعلى مستويات الصحة دون تمييز على أساس الإعاقة. وتتخذ الدول الأطراف كل التدابير المناسبة الكفيلة بحصول الأشخاص ذوي الإعاقة على خدمات صحية تراعي الفروق بين الجنسين، بما في ذلك خدمات إعادة التأهيل الصحي. وتعمل الدول الأطراف بوجه خاص على ما يلي:
25-(أ) توفير رعاية وبرامج صحية مجانية أو معقولة التكلفة للأشخاص ذوي الإعاقة تعادل في نطاقها ونوعيتها ومعاييرها تلك التي توفرها للآخرين، بما في ذلك خدمات الصحة الجنسية والإنجابية وبرامج الصحة العامة للسكان،
الاتفاقية الدولية لحماية حقوق جميع العمال المهاجرين وأفراد أسرهم 28 للعمال المهاجرين وأفراد أسرهم الحق في تلقي أية عناية طبية تكون مطلوبة بصورة عاجلة لحفظ حياتهم أو لتلافي ضرر لا يمكن علاجه يلحق بصحتهم وذلك على أساس المساواة في المعاملة مع رعايا الدولة المعنية. ولا يحرم هؤلاء من هذه العناية الطبية الطارئة بسبب أية مخالفة فيما يتعلق بالإقامة أو الاستخدام.
43.1 يتمتع العمال المهاجرون بالمساواة في المعاملة مع رعايا دولة العمل فيما يتعلق بما يلي:
43-1-(ه) إمكانية الحصول على الخدمات الاجتماعية والصحية، شريطة الوفاء بمتطلبات الاشتراك في برامج هذه الخدمات،
اتفاقية حماية حقوق الإنسان والحريات الأساسيية 3 لا يجــوز إخضاع أي إنســان للتعذيــب ولا لعقوبــات أو معاملات غير إنسانية أو مهينة.
8.1 لكل شــخص الحق في احترام حياته الخاصــة والعائلية وحرمة منزله ومراسلاته.
European Social Charter (Revised) Part II The Parties undertake, as provided for in Part III, to consider themselves bound by the obligations laid down in the following articles and paragraphs.
Part#II.11 With a view to ensuring the effective exercise of the right to protection of health, the Parties undertake, either directly or in cooperation with public or private organisations, to take appropriate measures designed inter alia:
Part#II.11.1 to remove as far as possible the causes of ill-health;
Part#II.11.2 to provide advisory and educational facilities for the promotion of health and the encouragement of individual responsibility in matters of health;
Part#II.11.3 to prevent as far as possible epidemic, endemic and other diseases, as well as accidents.
American Declaration on the Rights and Duties of Man II All persons are equal before the law and have the rights and duties established in this Declaration, without distinction as to race, sex, language, creed or any other factor.
XI Every person has the right to the preservation of his health through sanitary and social measures relating to food, clothing, housing and medical care, to the extent permitted by public and community resources
American Convention on Human Rights 26 The States Parties undertake to adopt measures, both internally and through international cooperation, especially those of an economic and technical nature, with a view to achieving progressively, by legislation or other appropriate means, the full realization of the rights implicit in the economic, social, educational, scientific, and cultural standards set forth in the Charter of the Organization of American States as amended by the Protocol of Buenos Aires.
Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural rights (Protocol of San Salvador) 3 The State Parties to this Protocol undertake to guarantee the exercise of the rights set forth herein without discrimination of any kind for reasons related to race, color, sex, language, religion, political or other opinions, national or social origin, economic status, birth or any other social condition.
10.1 Everyone shall have the right to health, understood to mean the enjoyment of the highest level of physical, mental and social well-being.
10.2 In order to ensure the exercise of the right to health, the States Parties agree to recognize health as a public good and, particularly, to adopt the following measures to ensure that right:
10.2.a Primary health care, that is, essential health care made available to all individuals and families in the community;
10.2.b Extension of the benefits of health services to all individuals subject to the State's jurisdiction;
10.2.c Universal immunization against the principal infectious diseases;
10.2.d Prevention and treatment of endemic, occupational and other diseases;
10.2.e Education of the population on the prevention and treatment of health problems,
10.2.f Satisfaction of the health needs of the highest risk groups and of those whose poverty makes them the most vulnerable.
15.3 The States Parties hereby undertake to accord adequate protection to the family unit and in particular:
15.3.a To provide special care and assistance to mothers during a reasonable period before and after childbirth;
الميثاق الأفريقي لحقوق الإنسان والشعوب 16.1 Every individual shall have the right to enjoy the best attainable state of physical and mental health.
16.2 States parties to the present Charter shall take the necessary measures to protect the health of their people and to ensure that they receive medical attention when they are sick.
18.3 The State shall ensure the elimination of every discrimination against women and also censure the protection of the rights of the woman and the child as stipulated in international declarations and conventions.
الميثاق الأفريقي بشأن حقوق ورفاهية الطفل 14.1 Every child shall have the right to enjoy the best attainable state of physical, mental and spiritual health.
14.2 State Parties to the present Charter shall undertake to pursue the full implementation of this right and in particular shall take measures:
14.2.e to ensure appropriate health care for expectant and nursing mothers;
14.2.f to develop preventive health care and family life education and provision of service;
بروتوكول الميثاق الأفريقي لحقوق الإنسان والشعوب بشأن حقوق المرأة 14.1 States Parties shall ensure that the right to health of women, including sexual and reproductive health is respected and promoted. This includes:
14.1.a the right to control their fertility;
14.1.b the right to decide whether to have children, the number of children and the spacing of children;
14.1.c the right to choose any method of contraception;
14.1.d the right to self-protection and to be protected against sexually transmitted infections, including HIV/AIDS;
14.1.e the right to be informed on one's health status and on the health status of one's partner, particularly if affected with sexually transmitted infections, including HIV/AIDS, in accordance with internationally recognised standards and best practices;
14.1.f the right to have family planning education.
14.2 States Parties shall take all appropriate measures to:
14.2.a provide adequate, affordable and accessible health services, including information, education and communication programmes to women especially those in rural areas;
14.2.b establish and strengthen existing pre-natal, delivery and post-natal health and nutritional services for women during pregnancy and while they are breast-feeding;
14.2.c protect the reproductive rights of women by authorising medical abortion in cases of sexual assault, rape, incest, and where the continued pregnancy endangers the mental and physical health of the mother or the life of the mother or the foetus.
