ما إذا كانت ثمة أطر قانونية قائمة، أم لا، من أجل تعزيز وإنفاذ ورصد المساواة وعدم التمييز على أساس نوع الجنس.
 ساننإعلان الخاص بالمدافعين عن حقوق الإال 1 من حق كل شخص، بمفرده وبالاشتراك مع غيره، أن يدعو ويسعى إلى حماية وإعمال حقوق الإنسان والحريات الأساسية على الصعيدين الوطني والدولي.
8.1 من حق كل شخص، بمفرده وبالاشتراك مع غيره، أن تتاح له بالفعل وعلى أساس غير تمييزي، فرصة المشاركة في حكومة بلده أو بلدها وفي تصريف الشؤون العامة.

8.2 ويشمل هذا، ضمن أمور أخرى، حق الشخص، بمفرده وبالاشتراك مع غيره، في تقديم انتقادات ومقترحات إلى الهيئات والوكالات الحكومية والمنظمات المعنية بالشؤون العامة لتحسين أدائها، وفي توجيه اﻻنتباه إلى أي جانب من جوانب عملها قد يعوق أو يعرقل تعزيز حقوق الإنسان والحريات الأساسية وحمايتها وإعمالها.
12.2 تتخذ الدولة جميع التدابير اللازمة التي تكفل لكل شخص حماية السلطات المختصة له، بمفرده وبالاشتراك مع غيره، من أي عنف، أو تهديد، أو انتقام، أو تمييز ضار فعلا أو قانونا، أو ضغط، أو أي إجراء تعسفي آخر نتيجة لممارسته أو ممارستها المشروعة للحقوق المشار إليها في هذا الإعلان.
الإعلان العالمي لحقوق الإنسان 2 لكل إنسان حق التمتع بكافة الحقوق والحريات الواردة في هذا الإعلان، دون أي تمييز، كالتمييز بسبب العنصر أو اللون أو الجنس أو اللغة أو الدين أو الرأي السياسي أو أي رأي آخر، أو الأصل الوطني أو الاجتماعي أو الثروة أو الميلاد أو أي وضع آخر، دون أية تفرقة بين الرجال والنساء. المادة 2.2: وفضلا عما تقدم فلن يكون هناك أي تمييز أساسه الوضع السياسي أو القانوني أو الدولي لبلد أو البقعة التي ينتمي إليها الفرد سواء كان هذا البلد أو تلك البقعة مستقلا أو تحت الوصاية أو غير متمتع بالحكم الذاتي أو كانت سيادته خاضعة لأي قيد من القيود.
العهد الدولي الخاص بالحقوق المدنية والسياسية 3 تتعهد الدول الأطراف في هذا العهد بكفالة تساوى الرجال والنساء في حق التمتع بجميع الحقوق المدنية والسياسية المنصوص عليها في هذا العهد.
العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية 2.2 تتعهد الدول الأطراف في هذا العهد بأن تضمن جعل ممارسة الحقوق المنصوص عليها في هذا العهد بريئة من أي تمييز بسبب العرق، أو اللون، أو الجنس، أو اللغة، أو الدين، أو الرأي سياسيا أو غير سياسي، أو الأصل القومي أو الاجتماعي، أو الثروة، أو النسب، أو غير ذلك من الأسباب.
3 تتعهد الدول الأطراف في هذا العهد بضمان مساواة الذكور والإناث في حق التمتع بجميع الحقوق الاقتصادية والاجتماعية والثقافية المنصوص عليها في هذا العهد.
اتفاقية القضاء على جميع أشكال التمييز ضد المرأة
2 تشجب الدول الأطراف جميع أشكال التمييز ضد المرأة، وتتفق على أن تنتهج، بكل الوسائل المناسبة ودون إبطاء، سياسة تستهدف القضاء على التمييز ضد المرأة، وتحقيقا لذلك تتعهد بالقيام بما يلي:
2-(أ) إدماج مبدأ المساواة بين الرجل والمرأة في دساتيرها الوطنية أو تشريعاتها المناسبة الأخرى، إذا لم يكن هذا المبدأ قد أدمج فيها حتى الآن، وكفالة التحقيق العملي لهذا المبدأ من خلال التشريع وغيره من الوسائل المناسبة،
2 تشجب الدول الأطراف جميع أشكال التمييز ضد المرأة، وتتفق على أن تنتهج، بكل الوسائل المناسبة ودون إبطاء، سياسة تستهدف القضاء على التمييز ضد المرأة، وتحقيقا لذلك تتعهد بالقيام بما يلي:
2-(ب) اتخاذ المناسب من التدابير، تشريعية وغير تشريعية، بما في ذلك ما يناسب من جزاءات، لحظر كل تمييز ضد المرأة،
2 تشجب الدول الأطراف جميع أشكال التمييز ضد المرأة، وتتفق على أن تنتهج، بكل الوسائل المناسبة ودون إبطاء، سياسة تستهدف القضاء على التمييز ضد المرأة، وتحقيقا لذلك تتعهد بالقيام بما يلي:
2-(ج) فرض حماية قانونية لحقوق المرأة على قدم المساواة مع الرجل، وضمان الحماية الفعالة للمرأة، عن طريق المحاكم ذات الاختصاص والمؤسسات العامة الأخرى في البلد، من أي عمل تمييزي،
2 تشجب الدول الأطراف جميع أشكال التمييز ضد المرأة، وتتفق على أن تنتهج، بكل الوسائل المناسبة ودون إبطاء، سياسة تستهدف القضاء على التمييز ضد المرأة، وتحقيقا لذلك تتعهد بالقيام بما يلي:
2-(و) اتخاذ جميع التدابير المناسبة، بما في ذلك التشريعي منها، لتغيير أو إبطال القائم من القوانين والأنظمة والأعراف والممارسات التي تشكل تمييزا ضد المرأة،
3 تتخذ الدول الأطراف في جميع الميادين، ولا سيما الميادين السياسية والاجتماعية والاقتصادية والثقافية، كل التدابير المناسبة، بما في ذلك التشريعي منها، لكفالة تطور المرأة وتقدمها الكاملين. وذلك لتضمن لها ممارسة حقوق الإنسان والحريات الأساسية والتمتع بها على أساس المساواة مع الرجل.
6 تتخذ الدول الأطراف جميع التدابير المناسبة، بما في ذلك التشريعي منها، لمكافحة جميع أشكال الاتجار بالمرأة واستغلال بغاء المرأة.
15.1 تعترف الدول الأطراف للمرأة بالمساواة مع الرجل أمام القانون.
15.2 تمنح الدول الأطراف المرأة، في الشئون المدنية، أهلية قانونية مماثلة لأهلية الرجل، وتساوى بينها وبينه في فرص ممارسة تلك الأهلية. وتكفل للمرأة، بوجه خاص، حقوقا مساوية لحقوق الرجل في إبرام العقود وإدارة الممتلكات، وتعاملهما على قدم المساواة في جميع مراحل الإجراءات القضائية.
15.3 تتفق الدول الأطراف على اعتبار جميع العقود وسائر أنواع الصكوك الخاصة التي يكون لها أثر قانوني يستهدف الحد من الأهلية القانونية للمرأة باطلة ولاغية.
15.4 تمنح الدول الأطراف الرجل والمرأة نفس الحقوق فيما يتعلق بالتشريع المتصل بحركة الأشخاص وحرية اختيار محل سكناهم وإقامتهم.
إعلان الأمم المتحدة بشأن حقوق الشعوب الأصلية 22.2 على الدول أن تتخذ، جنبا إلى جنب مع الشعوب الأصلية، تدابير لكفالة تمتع نساء وأطفال الشعوب الأصلية بالحماية والضمانات الكاملة من جميع أشكال العنف والتمييز.
إعلان بشأن القضاء على العنف ضد المرأة
4 ينبغي للدول أن تدين العنف ضد المرأة وألاّ تتذرع بأي عرف أو تقليد أو اعتبارات دينية بالتنصل من التزامها بالقضاء به،. وينبغي لها أن تتبع، بكل الوسائل لممكنة ودون تأخير ، سياسة تستهدف القضاء على العنف ضد المرأة ، ولهذه الغاية ينبغي لها:
4-(و) أن تصوغ ،على نحو شامل، النهج الوقائية وكل التدابير القانونية والسياسية والإدارية والثقافية التي تعزز حماية المرأة من جميع أشكال العنف وتكفل أن لا يتكرر إيذاء المرأة بسبب وجود قوانين وممارسات إنقاذية و أشكال تدخل أخرى لا تراعي نوع الجنس،
اتفاقية حماية حقوق الإنسان والحريات الأساسيية 14 يجــب تأمين التمتع بالحقوق والحريات المعتــرف بها في هذه الاتفاقية دون أي تمييــز، وتحديــداً ذاك القائم على الجنــس أو العنصر أو اللون أو اللغة أو الدين أو الآراء السياســية أو الأصل الوطني أو الاجتماعي أو الانتماء إلى أقلية وطنية، أو الثروة أو الولادة أو أي وضع آخر
American Declaration on the Rights and Duties of Man II All persons are equal before the law and have the rights and duties established in this Declaration, without distinction as to race, sex, language, creed or any other factor.
American Convention on Human Rights 1.1 The States Parties to this Convention undertake to respect the rights and freedoms recognized herein and to ensure to all persons subject to their jurisdiction the free and full exercise of those rights and freedoms, without any discrimination for reasons of race, color, sex, language, religion, political or other opinion, national or social origin, economic status, birth, or any other social condition.
2 Where the exercise of any of the rights or freedoms referred to in Article 1 is not already ensured by legislative or other provisions, the States Parties undertake to adopt, in accordance with their constitutional processes and the provisions of this Convention, such legislative or other measures as may be necessary to give effect to those rights or freedoms.
Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural rights (Protocol of San Salvador) 1 The States Parties to this Additional Protocol to the American Convention on Human Rights undertake to adopt the necessary measures, both domestically and through international cooperation, especially economic and technical, to the extent allowed by their available resources, and taking into account their degree of development, for the purpose of achieving progressively and pursuant to their internal legislations, the full observance of the rights recognized in this Protocol.
3 The State Parties to this Protocol undertake to guarantee the exercise of the rights set forth herein without discrimination of any kind for reasons related to race, color, sex, language, religion, political or other opinions, national or social origin, economic status, birth or any other social condition.
6.2 The State Parties undertake to adopt measures that will make the right to work fully effective, especially with regard to the achievement of full employment, vocational guidance, and the development of technical and vocational training projects, in particular those directed to the disabled. The States Parties also undertake to implement and strengthen programs that help to ensure suitable family care, so that women may enjoy a real opportunity to exercise the right to work.
Inter-American Convention on the Prevention, Punishment and Eradication of Violence Against Women 7 The States Parties condemn all forms of violence against women and agree to pursue, by all appropriate means and without delay, policies to prevent, punish and eradicate such violence and undertake to:
7.a refrain from engaging in any act or practice of violence against women and to ensure that their authorities, officials, personnel, agents, and institutions act in conformity with this obligation;
7.b apply due diligence to prevent, investigate and impose penalties for violence against women;
7.c include in their domestic legislation penal, civil, administrative and any other type of provisions that may be needed to prevent, punish and eradicate violence against women and to adopt appropriate administrative measures where necessary;
7.d adopt legal measures to require the perpetrator to refrain from harassing, intimidating or threatening the woman or using any method that harms or endangers her life or integrity, or damages her property;
7.e take all appropriate measures, including legislative measures, to amend or repeal existing laws and regulations or to modify legal or customary practices which sustain the persistence and tolerance of violence against women;
7.f establish fair and effective legal procedures for women who have been subjected to violence which include, among others, protective measures, a timely hearing and effective access to such procedures;
7.h adopt such legislative or other measures as may be necessary to give effect to this Convention.
8 The States Parties agree to undertake progressively specific measures, including programs:
8.a to promote awareness and observance of the right of women to be free from violence, and the right of women to have their human rights respected and protected;
8.b to modify social and cultural patterns of conduct of men and women, including the development of formal and informal educational programs appropriate to every level of the educational process, to counteract prejudices, customs and all other practices which are based on the idea of the inferiority or superiority of either of the sexes or on the stereotyped roles for men and women which legitimize or exacerbate violence against women;
8.c to promote the education and training of all those involved in the administration of justice, police and other law enforcement officers as well as other personnel responsible for implementing policies for the prevention, punishment and eradication of violence against women;
8.d to provide appropriate specialized services for women who have been subjected to violence, through public and private sector agencies, including shelters, counseling services for all family members where appropriate, and care and custody of the affected children;
8.e to promote and support governmental and private sector education designed to raise the awareness of the public with respect to the problems of and remedies for violence against women;
8.f to provide women who are subjected to violence access to effective readjustment and training programs to enable them to fully participate in public, private and social life;
8.g to encourage the communications media to develop appropriate media guidelines in order to contribute to the eradication of violence against women in all its forms, and to enhance respect for the dignity of women;
8.h to ensure research and the gathering of statistics and other relevant information relating to the causes, consequences and frequency of violence against women, in order to assess the effectiveness of measures to prevent, punish and eradicate violence against women and to formulate and implement the necessary changes;
8.i to foster international cooperation for the exchange of ideas and experiences and the execution of programs aimed at protecting women who are subjected to violence.
9 With respect to the adoption of the measures in this Chapter, the States Parties shall take special account of the vulnerability of women to violence by reason of, among others, their race or ethnic background or their status as migrants, refugees or displaced persons. Similar consideration shall be given to women subjected to violence while pregnant or who are disabled, of minor age, elderly, socioeconomically disadvantaged, affected by armed conflict or deprived of their freedom.
الميثاق الأفريقي لحقوق الإنسان والشعوب 2 Every individual shall be entitled to the enjoyment of the rights and freedoms recognized and guaranteed in the present Charter without distinction of any kind such as race, ethnic group, colour, sex, language, religion, political or any other opinion, national and social origin, fortune, birth or other status.
18.3 The State shall ensure the elimination of every discrimination against women and also censure the protection of the rights of the woman and the child as stipulated in international declarations and conventions.
الميثاق الأفريقي بشأن حقوق ورفاهية الطفل 1.1 Member States of the Organization of African Unity, Parties to the present Charter shall recognize the rights, freedoms and duties enshrined in this Charter and shall undertake the necessary steps, in accordance with their Constitutional processes and with the provisions of the present Charter, to adopt such legislative or other measures as may be necessary to give effect to the provisions of this Charter.
3 Every child shall be entitled to the enjoyment of the rights and freedoms recognized and guaranteed in this Charter irrespective of the child’s or his/her parents’ or legal guardians’ race, ethnic group, colour, sex, language, religion, political or other opinion, national and social origin, fortune, birth or other status.
بروتوكول الميثاق الأفريقي لحقوق الإنسان والشعوب بشأن حقوق المرأة 2.1 States Parties shall combat all forms of discrimination against women through appropriate legislative, institutional and other measures. In this regard they shall:
2.1.b enact and effectively implement appropriate legislative or regulatory measures, including those prohibiting and curbing all forms of discrimination particularly those harmful practices which endanger the health and general well-being of women;
2.2 States Parties shall commit themselves to modify the social and cultural patterns of conduct of women and men through public education, information, education and communication strategies, with a view to achieving the elimination of harmful cultural and traditional practices and all other practices which are based on the idea of the inferiority or the superiority of either of the sexes, or on stereotyped roles for women and men.
